We offer the Service, including all information, tools, and services available through it, to you, the user, on the condition that you accept all terms, conditions, policies, and notices in these Terms. By visiting or using the Service, or purchasing anything through it, you agree to be bound by these Terms. These Terms apply to all users of the Service, including browsers, customers, and anyone contributing content such as a review.

Our store is built on WooCommerce, which provides the e-commerce platform that allows us to sell our products and services to you.
Section 1: Online Store Terms
By agreeing to these Terms, you confirm that you are at least the age of majority in your country or region of residence (18, in Ireland and the UK), or that you have a parent or guardian’s consent to use the Site.
Tonstix products are formulated for children age 2 and up, but the Site itself is intended for use by parents, caregivers, and trade or healthcare professionals, not by children directly.
You may not use our products for any illegal or unauthorised purpose, and you may not, in your use of the Service, violate any laws in your jurisdiction, including copyright law. You must not transmit any worms, viruses, or code of a destructive nature. A breach of these Terms will result in immediate termination of your access to the Service.
Section 2: General Conditions
We reserve the right to refuse the Service to anyone, for any reason, at any time.
You understand that your content, other than payment information, may be transferred unencrypted and may involve transmission over various networks, and changes to conform to technical requirements of connecting networks or devices. Payment information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, or access to it, without our express written permission.
Headings used in these Terms are for convenience only and do not limit or affect the Terms.
Section 3: Accuracy, Completeness, and Timeliness of Information
We are not responsible if information on the Site is not accurate, complete, or current. Material on the Site is provided for general information only and should not be relied on as the sole basis for a decision, including any health-related decision, without consulting a more accurate, complete, or timely source, such as your doctor or pharmacist. The Site may contain historical information, which is provided for reference only and is not necessarily current. We may modify the contents of the Site at any time, but we have no obligation to update any information, and it’s your responsibility to monitor changes.

Section 5: Products and Services
Certain products may be available only through the Site and may have limited quantities. Products are subject to return or exchange only in accordance with our 30-Day Refund Policy. We’re not able to process refunds for orders marked as “return to sender” or items sent back outside of that process.
We make every effort to display product colours and images as accurately as possible, but we can’t guarantee that your device’s display will be fully accurate.
We reserve the right, but are not obliged, to limit sales of our products to any person, household, or region, on a case-by-case basis, and to limit quantities of any product we offer. Product descriptions and pricing are subject to change at any time without notice, and we may discontinue any product at any time. We reserve the right to limit or decline orders that, in our judgment, appear to be placed by resellers, dealers, or distributors without a trade agreement in place.
We don’t warrant that our products, the Site, or the Service will meet your expectations, or that any errors will be corrected.
Section 6: Health and Safety Information
Tonstix products are formulated for children age 2 and up. They are not a substitute for medical advice, diagnosis, or treatment. If your child has known allergies, is taking medication, has an underlying health condition, or if symptoms persist, please consult a doctor or pharmacist before use. Please check product packaging for full ingredient and allergen information before giving any Tonstix product to a child, as formulations may be updated from time to time.
Section 7: Accuracy of Billing and Account Information
We reserve the right to refuse any order. We may, at our discretion, limit or cancel quantities purchased per person, household, or order, including where the same account, payment method, or billing/shipping address is used across multiple orders. If we change or cancel an order, we’ll try to notify you using the contact details provided at checkout.
You agree to provide current, complete, and accurate information for all purchases, and to promptly update your account and billing details, including your email address and payment details, so we can complete transactions and contact you as needed. Section 8: Optional Tools
We may give you access to third-party tools that we don’t monitor and have no control over. Such tools are provided “as is” and “as available,” without any warranty or endorsement from us, and any use of them is at your own risk. You should review the third-party provider’s own terms before using such a tool. Any new features or tools we add to the Site in future are also subject to these Terms.

The Service may include materials from third parties, and the Site may link to third-party websites, including retailers who stock Tonstix products. We’re not responsible for the content, accuracy, or practices of any third-party site, and a link doesn’t mean we endorse it. We’re not liable for any harm relating to your use of a third-party site, product, or service. Please review the relevant third party’s own policies before you engage in any transaction with them.
Section 10: User Comments, Feedback, and Reviews
If you send us comments, suggestions, ideas, or product reviews, whether we requested them or not, you agree that we may, without restriction, edit, copy, publish, distribute, and otherwise use them in any medium, including in our marketing. We’re under no obligation to keep comments confidential, to compensate you for them, or to respond to them.
We may, but aren’t obliged to, monitor, edit, or remove content that we determine, at our discretion, to be unlawful, offensive, threatening, defamatory, or otherwise objectionable, or that infringes anyone’s rights or breaches these Terms.
You agree that your comments and reviews won’t violate any third party’s rights, including copyright or privacy, and won’t contain unlawful, abusive, or obscene material, or any virus or malware. You won’t use a false email address or misrepresent your identity. You’re solely responsible for your comments and their accuracy.

To the fullest extent permitted by law, Tonstix, Soothing Solutions Ltd, and our directors, officers, employees, and suppliers won’t be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Service or any product purchased through it, including lost profits or lost data, even if we’ve been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that can’t be excluded or limited under Irish or EU law, and where a jurisdiction doesn’t allow certain exclusions, our liability is limited to the maximum extent that jurisdiction permits.
Section 15: Indemnification
You agree to indemnify and hold harmless Tonstix, Soothing Solutions Ltd, and our officers, directors, agents, contractors, and employees from any claim or demand, including reasonable legal fees, made by a third party arising from your breach of these Terms or your violation of any law or a third party’s rights.
Section 16: Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will still be enforced to the fullest extent permitted by law, and the unenforceable part will be considered severed from these Terms, without affecting the validity of the remaining provisions.
Section 17: Termination
These Terms apply unless and until terminated by either you or us. You may stop using the Site at any time. If we believe you’ve failed to comply with any part of these Terms, we may terminate this agreement and deny you access to the Service at any time, without notice, and you’ll remain responsible for any amounts due up to the date of termination. Obligations incurred before termination will survive it.
Section 18: Entire Agreement
Our failure to exercise or enforce any right in these Terms doesn’t waive that right. These Terms, together with any policies referenced here, form the entire agreement between you and us regarding the Service, and supersede any prior agreements or communications, whether oral or written, including earlier versions of these Terms.

These Terms are governed by and construed in accordance with the laws of Ireland. Any dispute arising from these Terms or your use of the Site is subject to the exclusive jurisdiction of the Irish courts, without prejudice to any mandatory consumer protections available to you under the law of the country in which you live.
